Terms of Service. YeSolar - Solar System Calculator

By downloading or using YeSolar, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using YeSolar, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and agree to be bound by these Terms.

Important: This End-User License Agreement (EULA) is concluded between you and the Developer only, and not with Apple Inc. Maksym Stetsenko (the Developer, trading under the marketing name Data Science Enterprise), not Apple, is solely responsible for YeSolar and its content. This EULA may not provide for usage rules that conflict with Apple's Media Services Terms and Conditions.

2. Description of Service

YeSolar is a solar system calculator and installer marketplace. The service includes:

AI-powered roof scanning via satellite imagery
AR-based roof measurement for new or uncharted buildings
Solar panel count, energy output, and payback period estimation
PDF report generation for homeowners and installers
Installer marketplace and quote management

Important — estimates only: Roof scans, panel counts, energy output forecasts, and payback period estimates provided by YeSolar are indicative only. They are based on AI analysis of publicly available satellite imagery and location-specific solar data. Actual system performance and costs depend on physical site conditions, equipment selection, installer pricing, and local regulations. Always obtain a professional assessment from a qualified installer before making any purchasing decision.

3. License Scope

The Developer grants you a non-transferable license to use YeSolar on any Apple-branded devices that you own or control, as permitted by the Usage Rules set forth in Apple's Media Services Terms and Conditions. This license may be extended to other accounts associated with you via Family Sharing or volume purchasing where applicable.

4. Installer Marketplace

YeSolar may connect homeowners with third-party solar installation businesses ("Installers"). The following applies to marketplace interactions:

YeSolar is a platform only; we do not perform installations or guarantee any installer's work
Contracts, warranties, and payment for installation services are solely between you and the Installer
Installers are independently vetted but DSE does not guarantee their licensing, insurance, or quality of work
Any disputes with Installers must be resolved directly with them

5. Subscription and Payments

Free Plan: 3 roof scans per month
Homeowner Plan: Unlimited scans, AR measurement, PDF reports, and marketplace access — billed monthly through the Apple App Store at the price shown at the time of purchase
Installer Plan: Custom pricing for solar installation businesses
Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
Refunds are subject to Apple App Store refund policies
Unused scan quota does not carry over to the next month

6. Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for YeSolar, as specified in this agreement or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to YeSolar.

7. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event that YeSolar fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for YeSolar to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to YeSolar.

8. Product Claims

You acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to YeSolar or your possession and use of YeSolar, including but not limited to:

Product liability claims
Any claim that YeSolar fails to conform to any applicable legal or regulatory requirement
Claims arising under consumer protection, privacy, or similar legislation

9. Acceptable Use

You agree not to:

Use YeSolar for any unlawful purpose, including scanning properties you do not own or have permission to assess
Attempt to reverse engineer or circumvent scan limits or marketplace access controls
Share account credentials with others
Use YeSolar output as a substitute for a licensed structural or electrical assessment
Submit false property data or manipulate scan results

10. Intellectual Property

YeSolar and its content are owned by the Developer. You may not copy, modify, or distribute the app or its content without permission. PDF reports generated for your property remain yours for personal and professional use. AI-generated estimates are provided for your use only and may not be resold or relicensed.

In the event of any third-party claim that YeSolar or your possession and use of YeSolar infringes a third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

11. Legal Compliance

By using YeSolar, you represent and warrant that:

You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
You are not listed on any U.S. Government list of prohibited or restricted parties
You will comply with applicable third-party terms of agreement when using YeSolar

12. Privacy

Your use of YeSolar is governed by our Privacy Policy, which is incorporated into these Terms.

13. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings or by contacting support.

14. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, or consequential damages arising from your use of YeSolar, including any financial decisions made based on solar output estimates. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

15. Changes to Terms

We may update these Terms at any time. Continued use of YeSolar after changes constitutes acceptance. We will notify you of significant changes via the app.

16. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

17. Governing Law

These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine.
